Terms of service
Last updated 3 October 2026
These terms are an agreement between you and [Legal name of your business] (“we”, “us”), which runs Fresko (the “Service”). By creating an account or using the Service you agree to them. If you use the Service for a business, you agree on behalf of that business.
1. The Service
Fresko lets you upload images and use AI models to create renders, edited images, upscaled images, walkthrough videos and 3D models (“Outputs”), and to buy downloadable assets from our library. AI models are run by third-party providers on our behalf. We may add, change or remove models and features over time.
2. Your account
- You must be at least 18 years old and give a valid email address.
- You are responsible for everything done through your account. Keep access to your email secure, because we log you in with emailed links.
- One person per account. Don't share or resell access.
3. Credits, plans and payment
- The Service is paid for with credits. The credit price of each job is shown before you start it.
- Credits are taken when you start a job. If the job fails, the credits are returned automatically.
- Top-up credits do not expire while your account is open. Monthly plan credits are valid for the billing period they were granted for, do not roll over, and are used before top-up credits.
- Plans renew automatically every month until you cancel. You can cancel any time; the plan then ends at the end of the period you have paid for.
- Credits have no cash value, cannot be transferred and are not refundable except as set out in our Refund policy.
- Customers in India pay in Indian rupees through Razorpay. Customers elsewhere pay in US dollars through Paddle.com, which acts as our reseller and merchant of record for those orders and handles sales tax and VAT. Paddle's own buyer terms also apply to those purchases.
- We may change prices. Changes never affect credits you already hold, and plan price changes apply from your next billing period after we tell you.
4. Your content and Outputs
- You keep all rights in the images and files you upload (“Inputs”). You give us permission to store and process them, and to send them to our AI providers, only to run the Service for you.
- As between you and us, you own the Outputs you create and may use them for any lawful purpose, including commercial and client work. Similar Outputs may be created for other users, and we cannot guarantee that Outputs are unique or protected by copyright in every country.
- You must have the right to upload your Inputs. Do not upload content that infringes others' rights, or private information about people without their consent.
- We do not use your Inputs or Outputs to train AI models.
5. Acceptable use
Don't use the Service to:
- create unlawful, deceptive, defamatory, sexual or violent content, or content that harms minors;
- pass off AI Outputs as real photographs of built work in a way that misleads buyers, clients or authorities;
- infringe intellectual property or privacy rights;
- break, probe or overload the Service, scrape it, or get around credit or access limits;
- break the usage policies of the AI providers we use.
We may suspend or close accounts that break these rules.
6. Asset library licence
When you buy a library asset you get a non-exclusive, worldwide, perpetual, royalty-free licence to use it in your own and your clients' projects, including in renders, drawings, animations and models you deliver. You may not resell, share, sublicense or redistribute the asset file itself, on its own or as part of another asset library.
7. AI results — please check them
AI Outputs are visualisations, not technical drawings. They may change details, proportions, materials or surroundings. They are not suitable for construction, regulatory submissions or cost estimates without professional checking. You are responsible for how you use Outputs and what you tell clients about them.
8. Availability and changes
We work to keep the Service running, but it is provided “as is” and may sometimes be unavailable. We store your files so you can download them, but you should keep your own copies of anything important. We may change these terms; if a change is significant we will tell you by email or in the app before it applies.
9. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be excluded by law.
10. Ending your account
You can stop using the Service and ask us to delete your account at any time. We may end or suspend your access if you seriously or repeatedly break these terms. Unused top-up credits are lost when an account is closed for breaking these terms.
11. Governing law
These terms are governed by the laws of India, and the courts of Mumbai have jurisdiction, unless the law of the country you live in as a consumer gives you the right to bring claims in your local courts.
